News Release – October 13, 2009

PASADENA  COMPANY  FILES  FOR  BANKRUPTCY 

            U.S. Oil Recovery, L.P. a Pasadena, Texas based-business owned by international businessman Klaus Genssler, has filed for bankruptcy, in an apparent effort to avoid jail time for himself. The bankruptcy filing came after the first day of a hearing on a motion filed by Harris County for contempt of a court order. The hearing was to continue this morning, but Genssler’s attorneys told Judge Kyle Carter this morning that the entire case was removed to bankruptcy court. Genssler was not present in court. At 4 p.m. today, Harris County filed an emergency motion to have the case remanded back to Carter’s court.

 

            The county is suing U.S. Oil Recovery, L.P. and Genssler for violations of the Texas Clean Air Act, the Texas Clean Water Act and numerous environmental statutes and regulations concerning the improper storage and processing of industrial waste and the threat of spills into nearby Vince Bayou. The contempt motion seeks to enforce a June 8, 2009 temporary injunction order that required the businesses to stop taking in industrial waste until the plants could be operated without the risk of sending toxic waste into Vince Bayou.

 Court Orders  Owner to Remove 500 Barrels of Unknown Waste from Residential Property

         James Holbert, who left more than 500 unlabeled, dilapidated 55-gallon drums of chemicals at his now-defunct business four years ago, didn’t show up for court this morning, but Judge Sylvia A. Matthews conducted a hearing without him. She ordered Holbert to stop burning the waste, secure the property within 10 days, and find an environmental consultant to identify the contents of the barrels and determine how to legally dispose of the hazardous waste. Under her order, the property is to be cleaned up entirely within nine months.

Sexually Oriented Business in Spring Ordered to Immediately Cease All Operations 

 

     Harris County Attorney Vince Ryan announced today that D.B. Cooper’s Mansion, 22565  Interstate 45, Spring, has been ordered to cease operations immediately. 

 

       The County Attorney filed a suit against DB Cooper’s Mansion on June 23, 2009, claiming that DB Cooper's Mansion is a sexually oriented business that has been operating without a permit. Judge Randy Wilson issued a temporary injunction ordering DB Cooper’s Mansion to immediately cease all operations and to not operate the establishment until all permits required by Harris County have been obtained.

Harris County Attorney Vince Ryan, in a 300-page submittal to U.S. Attorney General Eric Holder, vigorously repudiated claims by the U.S. Department of Justice Civil Rights Division that conditions in the county jail violate the constitutional rights of jail inmates.
